Terms of Service

1. Acceptance of Terms

By accessing or using ShowUp Promise (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform. ShowUp Promise is operated by ShowUp Promise, Inc. (“we,” “us,” or “our”).

2. The Platform

ShowUp Promise is a marketplace that connects homeowners with local contractors. We are not a contractor, employer, or agent of any contractor. We provide the technology to facilitate connections, communications, scheduling, and payments between homeowners and independent contractors.

3. Accounts

  • You must be at least 18 years old to create an account
  • You are responsible for maintaining the security of your account credentials
  • You must provide accurate and complete information during registration
  • One person may not maintain more than one homeowner account
  • You are responsible for all activity that occurs under your account

4. For Homeowners

  • Service descriptions must be accurate and complete
  • You agree to be present or available during scheduled service appointments
  • Payment is due upon completion of work unless otherwise agreed in a quote
  • You agree to provide honest reviews and ratings of contractors
  • Cancellations within 2 hours of a scheduled appointment may incur a fee

5. For Contractors

  • You must hold all licenses and insurance required by your jurisdiction
  • You must maintain accurate availability and service area information
  • You agree to the ShowUp Promise reliability standards, including punctuality and communication
  • Trust metrics (show-up rate, response time, completion rate) are calculated from verified job data and displayed publicly
  • Repeated no-shows or cancellations may result in reduced visibility or account suspension
  • You are an independent contractor, not an employee of ShowUp Promise

6. Trust Metrics & Reviews

Our trust system is central to ShowUp Promise. Trust metrics are calculated from real job data and cannot be purchased or artificially inflated.

  • Reviews must reflect genuine experiences
  • Fake, incentivized, or retaliatory reviews are prohibited
  • We reserve the right to remove reviews that violate these terms
  • Contractors may respond to reviews publicly

7. Payments

  • Payments are processed through our third-party payment provider
  • ShowUp Promise charges a service fee on each transaction
  • Contractors receive payment after job completion confirmation
  • Disputes should be raised within 48 hours of job completion
  • We may mediate disputes but are not liable for the quality of work performed

8. Prohibited Conduct

  • Circumventing the Platform to avoid fees (e.g., arranging payment off-platform)
  • Providing false information in your profile, reviews, or service requests
  • Harassing, threatening, or discriminating against other users
  • Using the Platform for any unlawful purpose
  • Attempting to manipulate trust metrics or matching algorithms
  • Scraping, reverse engineering, or copying the Platform

9. Limitation of Liability

ShowUp Promise is a marketplace platform. We do not perform, guarantee, or insure any contractor's work. To the maximum extent permitted by law, ShowUp Promise shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of the Platform or any services obtained through it. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless ShowUp Promise, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform, your violation of these terms, or your violation of any rights of another party.

11. Dispute Resolution

Any disputes arising from these terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive the right to a jury trial and to participate in class action lawsuits.

12. Modifications

We may modify these terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.

13. Termination

We may suspend or terminate your account at any time for violation of these terms. You may delete your account at any time. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive (including limitation of liability, indemnification, and dispute resolution) will survive termination.
